Procedure for amateur photo and video shooting at railway facilities

Public relations in the field of collection, storage and dissemination of information are regulated by the Law of the Republic of Belarus dated 11/10/2008 "On Information, Informatization and Information Protection" (hereinafter referred to as the Law).

Under Article 6 of the Law, individuals are entitled to search, receive, transfer, collect, process, accumulate, store, disseminate and (or) provide information, use information in accordance with the Law and other legislative acts of the Republic of Belarus.

Acts of the legislation of the Republic of Belarus provide for certain restrictions on photo and video shooting, including at railway facilities.

In particular, Article 43 Part 3 of the Law of the Republic of Belarus dated 07/21/2008 “On the State Border of the Republic of Belarus” establishes a ban on photo and video shooting at checkpoints across the State Border of the Republic of Belarus (hereinafter referred to as checkpoints). The list of checkpoints located at railway terminals (stations) is approved by the Decree of the President of the Republic of Belarus dated 05/10/2006 No. 313 “On checkpoints across the State border of the Republic of Belarus and the types of controls exercised in them”.

In order to ensure the protection of goods en route and at railway stations, objects of organizations of public railway transport at the objects of the Belarusian Railway, the access control is established.

Filming and photographing at railway infrastructure facilities, where the technological process is carried out, or in the restricted areas of protected objects, are carried out only upon written permission of the management of a branch of the Belarusian Railway.

The ban on filming and photographing does not apply to those intended for personal use, carried out in places specially designed for being and servicing passengers at railway terminals, stations, stopping points, not violating the production process, not creating inconvenience and danger to passengers and film- or photomakers.

Obtaining permissions for amateur photo and video shooting in places specially designed for being and servicing passengers located at railway terminals, stations, stopping points, as well as from territories located outside railway facilities is not required as photographic images of railway objects refers to publicly available information.

Based on the foregoing, in the absence of restrictions on photo and video shooting established by legislative acts, observance of the Rules for being of citizens and placing of objects in high-risk areas, performing of work in these areas, driving and crossing railway lines, citizens can take photos and videos in places specially designed for being and servicing passengers located at railway terminals, stations, stopping points, as well as from territories located outside railway facilities.

At the same time, according to Article 27 of the Law of the Republic of Belarus dated 01/06/1999 “On Railway Transport”, railway lines, railway stations, passenger platforms and stopping points, as well as other facilities of public railway transport organizations intended for the movement of railway transport vehicles, are high-risk areas and, if necessary, in order to ensure the safety of movement and operation of railway transport, are subject to fencing by their owners.

The conditions for safe being of citizens in high-risk areas are determined by the Rules for being of citizens and placing of objects in high-risk areas, performing of work in these areas, driving and crossing railway lines approved by the Decree of the Ministry of Transport and Communications of the Republic of Belarus dated 06/30/2015 No. 27.

Administrative responsibility for passing on railway lines or being on railway lines in not specially designed place is established by Article 18.3 Clause 5 of the 

Administrative Offences Code of the Republic of Belarus.
